Apple Pie McFlurry 2.0 Competition

1: Overview (a) This Apple Pie McFlurry 2.0 competition (Competition) is promoted by Uber Australia Pty Ltd (ABN 49 160 299 865) of 1 O’Connell Street, Sydney, New South Wales, 2000 (we, us or our). (b) By entering this Competition, all entrants (you or your) will be deemed to have accepted and agreed to be bound by these terms (Terms) and our privacy policy. Any breach of these Terms or our privacy policy may result in disqualification from the Competition. (c) These Terms prevail to the extent of any inconsistency between these Terms and any other reference to this Competition. (d) The Competition: (i) begins at 10am Australian Eastern Standard Time (AEST) on Friday 5 July 2019; and (ii) ends at 10am AEST on Monday 8 July 2019, (Promotion Period).

2: Eligibility (a) The Competition is open to Australian residents aged 18 years and over at the time of entry. (b) Our employees and contractors (and their Immediate Families) and the agencies associated with this Competition may not enter. (c) Immediate Families means any of the following (whether natural, step or adopted): spouse, ex-spouse, de-facto spouse, child, parent, grandparent, uncle, aunt, niece, nephew or sibling.

3: How to enter (a) To enter the Competition, you must do the following during the Promotion Period: (i) visit the competition post on our Australian Facebook page (Competition Post); and (ii) leave a comment on the Competition Post telling us why you love the McDonald’s® Apple Pie McFlurry. (b) This Competition is a game of skill. The 5 most creative entries will win. (c) You need a Facebook account to enter the Competition. (d) This Competition is not sponsored, endorsed or administered by, or associated with, Facebook. (e) Entry is limited to 1 per person during the Promotion Period. If you submit multiple entries, you will be disqualified from the Competition. (f) We will not accept any entries submitted after the end of the Promotion Period. (g) The time of each entry will be the time stamped on your comment, as shown on our device. (h) We may at any time verify the validity of entries and entrants (including your identity, age and place of residence) and disqualify any entrant whose entry is not in accordance with these Terms or who otherwise tampers or interferes with the entry process. (i) We accept no responsibility for any incomplete, lost, late or misdirected entries.

4: Determination (a) The 5 most creative entries will win the Competition. (b) The winners will be determined by a judging panel: (i) at our office at 1 O’Connell Street, Sydney, New South Wales, 2000; and (ii) between 10:01am and 5pm AEST on Monday 8 July 2019. (c) We may select additional reserve entries and record them in order of first runner up to last runner up in case an invalid entry or ineligible entrant is selected.

5: Outcome (a) We will notify the winners that they have won after 5pm AEST on Monday 8 July 2019 by replying to their entries on the Competition Post. (b) We will then send the promo code prizes to the winners via direct message to the Facebook profile they used to enter the Competition. (c) The winners’ names, entries and Facebook profiles may be published on our Facebook, Instagram and Twitter pages, and in any other promotional material we consider relevant. By entering the Competition, you consent to us publishing your details. (d) Our judging panel’s decision is final and we will not enter into any communication in relation to the decision or the associated process.

6: Prizes (a) The total prize pool value for this Competition is AUD $500 (inclusive of GST). (b) Each winner will receive a $100 promo code to use on the Uber Eats app in Australia. (c) The promo code may only be redeemed on 1 order and cannot be used in conjunction with another promo code. Promo code expires at 11:55pm AEST on 31 December 2019. (d) Prizes, or any unused portion of a prize, are not transferable and cannot be redeemed as cash. Prizes must be claimed as offered and cannot be varied or exchanged.

7: Entries (a) We own all entries, including all intellectual property rights comprised in the entries. (b) You are responsible for the entry you submit, including its text, images, photos and videos. (c) We will not be liable in any way for your entry to the fullest extent permitted by law. (d) We may remove an entry for any reason and without notice. (e) You warrant that: (i) you will not submit an entry that is unlawful or fraudulent, or that we could reasonably consider to be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (ii) you will obtain prior written consent from any person that appears or is identifiable in your entry, or who has any rights in your entry; (iii) your entry does not contain viruses and will not cause injury or harm to any person or entity; and (iv) you will comply with all applicable laws and regulations, including those governing copyright, content, defamation, privacy, publicity and the access or use of third party computer or communication systems. (f) You consent to us using your entry in any media for an unlimited period without remuneration for the purposes of promoting: (i) this Competition (including any outcome); and (ii) any products or services we develop, distribute or supply.

8: Personal information (a) We collect personal information to conduct the Competition and may disclose this information to third parties for this purpose, including to contractors, service providers and Australian regulatory authorities. (b) Our privacy policy sets out how we handle your personal information, including how you can access, correct, update or delete your personal information.

9: Liability (a) To the fullest extent permitted by law, we make no express or implied warranties, representations or guarantees regarding this Competition or the quality or fitness for a particular purpose of any prize. (b) Nothing in these Terms excludes, restricts or modifies the rights and remedies in relation to goods or services under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified (Non-excludable Guarantees). (c) Except for the Non-excludable Guarantees and any other liability that cannot be excluded by law, we (including our officers, directors, employees, contractors and agents) exclude all liability (including for negligence) for any personal injury or loss or damage (including loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Competition, including where arising out of: (i) a technical difficulties (whether or not under our control); (ii) a variation in prize specification to that stated in these Terms; or (iii) use of the prize by the winners. (d) We are not responsible for any technical malfunction, error, omission, deletion, delay in transmission, unauthorised access or alteration relating to the entries or any other event beyond our control. In these circumstances, we may, in our absolute discretion, cancel the Competition (without liability) and recommence it from the start on the same conditions. (e) We accept no responsibility for your use, or attempted use, of Facebook. (f) Without limiting any other terms, you indemnify us (and our officers, directors, employees, contractors and agents) against your breach of these Terms.

10: Disruption to Competition If this Competition is interfered with or not capable of being conducted as planned due to a reason beyond our reasonable control, which corrupts or affects the administration, security, fairness or integrity of this Competition, we may: (a) disqualify any entrant who tampers or interferes with the Competition; or (b) cancel, modify, reschedule or suspend the Competition, as appropriate.

11: General (a) Any failure to enforce any of our rights does not constitute a waiver of those rights. (b) At all relevant times, you must agree to, and comply with, any terms and conditions imposed by Facebook.
